Get That Child And Pet Out Of That Hot Car
We have all seen this happen: you are in a strip mall parking lot and you see a dog or child sitting in a hot car in the middle of summer with all the windows rolled up and the doors locked. Do you alert a store manager? Do you phone 9-1-1? Or, do you decide to become a good Samaritan, bust open a window, and rescue that pet or kid?
Well, up until now, if you do any damage to that vehicle to perform that rescue operation, you would not be liable for civil damages, but you could still be charged with a crime. According to an article written by Greg Haas on 8NewsNow.com, Nevada Senate Bill 190 passed a vote in the Senate Judiciary Committee today (Thursday, March 30). If it passes on the Nevada Senate floor to become a state law, it will remove criminal penalties from rescue operations which damage vehicles.
It is hard to believe that this is not already a state law. Thankfully, our legislators have already removed the civil penalties from these rescue operations. This seems like a “no-brainer” to me, but there are stipulations in this newly proposed law.
Per Haas’ article, if you decide to rescue a pet or child from a hot vehicle, you must first make sure all of the doors are actually locked. You have to make sure there is no other way to successfully protect the “victim” inside the car. You must first report the violation to legal authorities, and then you must remain on the scene and cooperate with authorities after they arrive. And then, you must remain with the child or pet until you are informed that your presence is no longer needed.
I sure hope this proposed bill passes the Nevada Senate quickly, because summer is coming, and you hear stories about these incidents way too often here in the Las Vegas Valley.
