If you are under the age of 40, or you even look younger than 40, get ready to show your ID every time you purchase tobacco or vaping products.
According to an article written by Sean DeLancey on KTNV.com, a Nevada Assembly bill which passed last year has updated regulatory statutes to require tobacco retailers "to use scanning technology or an 'automated software-based system' to verify age on anyone under the age of 40 before making the sale." Although this is going to be a pain for anyone over 21, the main purpose of the revised regulations is to prevent minors from purchasing tobacco and vaping products.
Apparently, it's vaping products which are really popular with Nevada's teenagers. DeLancey's article reports the findings of the Nevada Youth Risk Behavior Survey, conducted from 2019 to 2021, which shows that "nearly 37% of high school students have used electronic vapor products, including e-cigarettes, vapes, vape pens, e-cigars, e-hookahs, hookah pens and mods, and 10% reported having first used these products before the age of 13."
In addition, 48% of Nevada's high school students in this survey felt it would be "Fairly/Very Easy" to purchase electronic vaping products. So now, tobacco and vaping product retailers will have to be much more diligent in scanning IDs for anyone who even looks under the age of 40.
Per DeLancey's article, regular inspections by investigators will fine a retailer $100 dollars for completing a sale of tobacco or tobacco-related products to anyone under 21. There will be another $100 fine if that retailer fails to utilize scanning or software-based technology to check any customer's ID, regardless of age.
One of the reasons for this year's crackdown is that the Centers for Disease Control and Prevention (CDC) has determined that "tobacco use is the number one cause of preventable disease, disability, and death." DeLancey's website post goes on to add: "The CDC defines tobacco use, predominately e-cigarette use in young adults aged 18-20, as an epidemic.
